Nature Photo Collection

Thank you for purchasing the Nature Photo Collection CD-ROM. This
collection offers you 100 8 Bit & 24 Bit BMP files for desktop
publishing and multimedia projects. Each of the 100 8 Bit files
are about 700 K in size and are about 470 by 720 pixels at 72 DPI,
making them ideal for multimedia use. The 24 Bit images are 2
megabyte files each, but otherwise they are identical to the 8
bit images.

Also included on this disc is an easy to use, yet powerful, Browser
program. The Browser program lists each of the photos' names and
will show a thumbnail of any photo whose name you click on. After
clicking a name, you can install the 8 bit version as your Windows
wallpaper or copy either the 8 or 24 bit version to any drive.

The Browser program, image files and compilation are Copyright 1994,
BeachWare, Inc. The purchasor of this disc is granted royalty-free,
unrestricted usage of the images on this disc. The images may be used
in both digital multimedia and printed formats. The only restriction
is that they may not be included as a library of images on any other
digital or printed format without permission from BeachWare.

BeachWare grants only a nonexclusive right to use the Browser Software
contained on this CD-ROM on a single computer. This Software is
licensed, not sold to End-User and title to all copies of Software
remains with BeachWare. The End-User of this CD may make one copy of
the Software in machine-readable form for backup purposes only. The
End-User is prohibited from decompiling, disassembling or otherwise
reducing the Software to a human-perceivable form and modifying,
adapting, leasing, loaning or creating derivative works based upon
the Software or any part thereof. The End-User is prohibited from
transfering the Software to another party except as authorized by
Licensee subject to the restrictions set forth in this Agreement. The
End-User is prohibited from exporting or re-exporting , directly or
indirectly, the Software in contravention of the laws and regulations
of the United States or as appropriate other foreign jurisdictions.

BEACHWARE MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING WITHOUT
LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR
A PARTICULAR PURPOSE, REGARDING THE SOFTWARE.  BEACHWARE DOES NOT
WARRANT, GUARANTEE OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR
THE RESULTS OF THE USE OF THE SOFTWARE IN TERMS OF ITS CORRECTNESS,
ACCURACY, RELIABILITY, CURRENTNESS OR OTHERWISE.  THE ENTIRE RISK AS
TO THE RESULTS AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU.
BECAUSE THE EXCLUSION OF IMPLIED WARRANTIES IS NOT PERMITTED BY SOME
JURISDICTIONS, THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

IN NO EVENT WILL BEACHWARE, AND THEIR DIRECTORS, OFFICERS, EMPLOYEES
OR AGENTS (COLLECTIVELY BEACHWARE, INC. (LICENSOR)) BE LIABLE TO YOU
FOR ANY CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES (INCLUDING
DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF
BUSINESS INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OR
INABILITY TO USE THE SOFTWARE EVEN IF BEACHWARE HAS BEEN ADVISED OF
THE POSSIBILITY OF SUCH DAMAGES.  BECAUSE SOME JURISDICTIONS DO NOT
ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR
INCIDENTAL DAMAGES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
BeachWare's liability to you for actual damages from any cause
whatsoever, and regardless of the form of the action (whether in
contract, tort (including negligence), product liability or
otherwise), will be limited to $50.
